I. Introduction

These terms and conditions govern the relationship between us as the seller and you as the buyer when making purchases in the online store de.mycrush.cz (hereinafter referred to as “MyCrush”). These terms and conditions form an integral part of the purchase agreement. If we agree otherwise in our communication than what is stated here, our agreement shall prevail.

If you are not purchasing in the course of business, you are a consumer and have special rights under applicable legal regulations.

II. Offer of Goods and Conclusion of the Contract

• All presentation of goods on the e-shop is for informational purposes only and does not constitute an offer to conclude a contract.
• The purchase agreement is concluded only at the moment of the seller’s express confirmation of the order.
• Confirmation is made by e-mail or system message, e.g.: “We confirm that your order no. XYZ has been received and the contract has been concluded.”

III. Order

• You place an order by completing the form on the website and clicking “submit order”.
• Before submission, you may check and amend the entered details.
• We will send you an order confirmation by e-mail. The purchase agreement is concluded at the moment the confirmation message is delivered.
• If the order is unusual (e.g. a large quantity), we may request additional confirmation.

IV. Goods

Clothing

• We provide a description, sizes, material composition, and price.
• Prices include VAT. Shipping and packaging costs are not included.

Food Supplements

• Food supplements are foods within the meaning of Act No. 110/1997 Coll., on Foodstuffs.
• The labelling contains mandatory information in accordance with Regulation (EU) No. 1169/2011 – ingredients, nutritional values, dosage, and the warning “food supplement is not a substitute for a varied diet”.
• Products may not be presented as medicinal products and must not contain prohibited substances.
• Mandatory warnings:
• “Do not exceed the recommended daily dosage.”
• “Food supplement is not a substitute for a varied diet.”
• “Not intended for children, pregnant or breastfeeding women, unless stated otherwise.”
• Returns are not possible for unsealed food products for hygiene reasons.

V. Delivery

• We will deliver the goods by the method you choose when placing the order.
• The standard dispatch period is within 3 business days from the date the payment is credited to our bank account.
• You are obliged to accept the goods. If you fail to do so, we may claim compensation for damages.
• Please inspect the goods immediately upon receipt and inform us of any defects without delay.

VI. Payment

You may pay the purchase price by:

• instant bank transfer
• online card payment
• cash on delivery
• cash upon personal collection

The purchase price is payable in advance. We dispatch the goods after the amount has been credited to our account. We send invoices electronically. We are VAT payers.

VII. Withdrawal from the Contract

• The consumer has the right to withdraw from the contract within 14 days of receipt of the goods without stating any reason.
• Withdrawal must be notified by e-mail or letter.
• The goods must be returned complete, undamaged, and unused.
• The consumer bears the cost of returning the goods.
• Withdrawal is not possible for goods subject to rapid deterioration or for unsealed food products for hygiene reasons.
• If a gift was provided together with the goods, it must be returned together with the goods.

VIII. Complaints

• We are responsible for ensuring that the goods are free from defects upon receipt.
• Complaints may be submitted by e-mail to info@mycrush.cz or by letter to the registered office address.
• A complaint must contain contact details, a description of the defect, and proof of purchase.
• We will handle the complaint without undue delay, no later than within 30 days.
• The consumer has the right to request repair, replacement, a discount, or withdrawal from the contract depending on the nature of the defect.
• In the case of food products, defects caused by improper storage by the customer or goods subject to rapid deterioration cannot be claimed.

IX. Contract Archiving

• The concluded contract is archived in electronic form by the seller.
• It is not publicly accessible.

X. Final Provisions

• The consumer has the right to out-of-court dispute resolution through the Czech Trade Inspection Authority (adr.coi.cz).
• The contract is governed by Czech law.
• The contract is concluded in the Czech language.
• All website content is protected by copyright.
• We may amend or supplement the wording of these terms and conditions.
